These User Terms (the “Terms”) govern your access to and use of the cas.ai website, the CAS.AI dashboard and user accounts, our software development kits, APIs, documentation, and related services (collectively, the “Services”), operated by CLEAR INVEST LTD, a Belize corporation doing business as Clever Ads Solutions (“CAS.AI”, “we”, “us”, “our”), with its registered office at New Horizon Building, Ground Floor, 3 1/2 Miles Philip S.W. Goldson Highway, Belize City, Belize.
By creating an account, signing in — including via a third-party identity provider such as Google — or otherwise using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Services.
CAS.AI provides an advertising mediation and monetization platform for mobile applications, including a hybrid real-time bidding and waterfall auction, a modular SDK with ad network adapters, a reporting and management dashboard, and app publishing services. Certain features may include AI-assisted tools. We may add, change, or discontinue features at any time.
The Services are intended for business and professional use. You must be at least 18 years old and have the authority to bind the company or individual on whose behalf you use the Services. The Services are not directed at children, and we do not knowingly allow children to create accounts.
You may register an account directly or sign in through a supported third-party identity provider (such as Google) using OAuth. When you use third-party sign-in, you authorize us to receive basic profile information (such as your name and email address) from that provider, which we handle as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use. Information you provide must be accurate and kept up to date.
We may verify your identity, your business details, and your ownership or control of the applications you connect to the Services. We may decline, limit, or revoke access if verification fails, if information you provided is inaccurate, or if your use of the Services violates these Terms or applicable law.
You agree not to:
– use the Services in violation of applicable law or the policies of the app stores and advertising networks you work with;
– generate, encourage, or fail to take reasonable steps to prevent invalid traffic, fraudulent ad interactions, or misrepresentation of app content or audiences;
– interfere with, disrupt, probe, or circumvent security or technical limitations of the Services;
– reverse engineer, decompile, or create derivative works of the Services except where permitted by law;
– resell or provide access to the Services to third parties except as expressly permitted by a separate agreement with us;
– upload malicious code or use the Services to infringe the rights of others.
The Services, including the SDK, dashboard, documentation, and all related content, are owned by CAS.AI or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No rights are granted except as expressly stated in these Terms or a separate agreement. Feedback you provide may be used by us without restriction or obligation to you.
Revenue share, payouts, reporting, and other commercial terms for the mediation platform and publishing services are governed by separate agreements between you and CAS.AI (such as a publisher agreement or public offer). If those agreements conflict with these Terms, the separate agreement prevails with respect to its subject matter.
The Services interoperate with third-party services, including advertising networks, identity providers, and app stores. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
Our collection and use of personal information in connection with the Services is described in our Privacy Policy. Where you use third-party sign-in, our use of information received from the identity provider is limited to providing and improving the Services as described there.
The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or any particular level of revenue, fill rate, or advertising performance.
To the maximum extent permitted by law, CAS.AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Services or these Terms. Our aggregate liability under these Terms will not exceed the greater of (a) the amounts payable by us to you under a separate commercial agreement for the three months preceding the claim, or (b) one hundred (100) US dollars. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
You will indemnify and hold CAS.AI harmless from claims, damages, and expenses (including reasonable legal fees) arising from your applications, your content, your violation of these Terms, or your violation of applicable law or third-party rights.
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use creates risk or possible legal exposure for us. Sections that by their nature should survive termination (including Sections 6, 10–12, and 15) will survive.
We may update these Terms from time to time. The current version will always be available on this page, with the effective date above. Material changes will be communicated through the Services or by other reasonable means. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Belize, without regard to conflict-of-law rules. Disputes arising out of these Terms or the Services will be subject to the exclusive jurisdiction of the courts of Belize, unless mandatory law in your jurisdiction provides otherwise.
